Recently, our Chicago consumer law attorneys,

Attorney Penelope N. Bach asked the bankruptcy court to review a case for our client, Renato Casali.
Casali filed for
Chapter 7 bankruptcy on July 31, 2013. Prior to filing, Casali opened a home equity line with
Parkway Bank & Trust, a local financial institution. Upon discovering
Casali’s choice to file for bankruptcy, the institution filed a
lawsuit against him.
Parkway Bank & Trust stated that Casali made knowing misinterpretations
when he sought relief from the loan. The institution claimed that one
of their debts is considered non-dischargeable due to the United States
code, 11 U.S.C. § 523(a)(2)(A). This code states that a bankruptcy
will not release an individual from any debt in the form of property,
finances, or services attained by fraud, false pretenses, or false representation.
In the complaint, Parkway Bank & Trust attempts to explain that Casali
did not provide accurate statements when he borrowed money from the institution.
However, Mr. Bach and Ms. Bach of Sulaiman Law Group, LTD. argue that Parkway
Bank & Trust fails to provide any evidence that can prove Casali made
knowing misinterpretations when he obtained a mortgage loan from Parkway
Banks & Trust. As a result, our Chicago consumer lawyers have asked
the bankruptcy court to review the case and grant Casali the ability to
discharge the loan by filing for Chapter 7 bankruptcy.
